Policies and Procedures

 

 

Cultural Bridge Project reserves the right to cancel any trip prior to departure for any reason whatsoever, including force majeure (unsafe conditions, war, riots, strikes, earthquake, flooding, etc.), insufficient registration, or logistical issues that may impede trip operations. The refund of payments received by participants shall release Cultural Bridge Project from all liability. 

 

In the event that a trip is cancelled, Cultural Bridge Project will promptly refund all deposits and payments made to Cultural Bridge Project from registered participants. Cultural Bridge Project is not responsible for expenses incurred by participants in preparation for a trip (i.e, nonrefundable air tickets, passport/visa fees, inoculations, equipment, etc.) 

 

In the event that it becomes necessary for a participant to cancel a trip, a full refund will be issued with written cancellation notice, which can be sent by email or standard mail received thirty (30) days prior to the trip departure date.

Cultural Bridge Project shall not be liable for (a) expenses such as additional hotel nights and meals not specified in trip itineraries (b) expenses due to the delay of a trip for any reason (i.e., weather conditions, social conditions, sickness, etc.) (c) expenses incurred in recovering luggage lost by airlines, belongings left behind on a trip, or in shipping purchases or other goods home from abroad.

The payment of a deposit represents acceptance by all registered participants of this Release of Liability, Assumption of Risks, and Binding Arbitration Agreements.

 

Cultural Bridge Project reserves the right to refuse a trip participant, or remove from a trip, at his/her own expense/without refund, any person it judges to be incapable of participating in the activities, or who it determines detracts from the enjoyment of the trip by other participants. Participants agree to follow all written and verbal rules of safety or otherwise presented by Cultural Bridge, trip leaders, and local artists and guides. Cultural Bridge Project reserves the right to make route, hotel, itinerary, leader changes and trip modifications as required or desirable to improve the trip quality and/or to accommodate the comfort and well-being of participants.

All participants voluntarily register for all trips with the knowledge of the numerous risks and dangers involved including but not limited to negligence on the part of Cultural Bridge Project (i.e., negligence in the conduct or arrangement of the trip in any respect from inception to completion, negligence with regard to selection of suppliers, hotels, locations, etc.) Participants agree to be responsible for their own welfare and accept any and all risks of delay, unanticipated events, inconvenience, illness, injury, emotional trauma, or death.

 

Cultural Bridge Project, its employees, subsidiaries, affiliates, directors and successors, (Cultural Bridge Project) does not own or operate any entity that provides goods or services for the trips including, lodging facilities, boat, bus, and other transportation companies, food service providers, equipment suppliers, local artists, guides, etc. Cultural Bridge is not liable for any negligent, willful act, or failure to act of any such person, entity, or third party.

 

Cultural Bridge is not liable for any direct, indirect, consequential, or incidental damage, injury, death, loss, accident, delay, inconvenience, or irregularity of any kind that may occur by any act or omission beyond its control, including without limitation any willful or negligent act, failure to act, breach of contract or violation of local law or regulation of any third party such as an airline, hotel, train, automobile, bus, taxi, boat or vessel, local artist or guide, financial default or insolvency of any supplier that provides any goods or services for trips. Cultural Bridge Project is not responsible for any loss, injury, death or inconvenience due to delay or change in schedule, accommodation overbooking, default of any third party, injuries from pests or animals, sickness, lack of appropriate medical care, and/or evacuation, force majeure, weather, strikes, government, war, crime, lost or misplaced luggage, or any other cause beyond its control.

 

Any dispute concerning, relating, or referring to this contract, online information, or any other literature concerning the trip, or the trip itself, shall be resolved exclusively by binding arbitration in Philadelphia, Pennsylvania. Such proceedings will be governed by substantive (but not procedural) Pennsylvania law. The arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable.

 

Cultural Bridge Project reserves the right to take photographic or film records of our trips and participants, and may use any such records for marketing, promotional, and/or commercial purposes. The payment of a deposit by the registered participant(s) grants Cultural Bridge Project unrestricted permission to copyright and/or use, and/or publish any and all images or recordings in which the participant(s) may be included throughout all media in perpetuity.
